Display fumigation activities with biocidal products or plant protection products

If you wish to carry out fumigation activities with biocidal products or plant protection products, you must notify the competent authority.

Anyone wishing to carry out fumigation with fumigants on a commercial basis or independently as part of other economic activities outside a fixed facility may also require a permit from the competent authority. The employer must also notify the competent authority in advance of each fumigation activity. In addition, a collective notification may be approved if fumigation is repeated regularly and the conditions described in the notification remain unchanged.

Prerequisite

Fumigation may only be carried out if its use is not expected to have any harmful effects on the health of humans, non-target organisms or the environment in individual cases.

Responsible department

The locally responsible regional councils for company premises on which at least one installation is present,

  • which is subject to the EU Industrial Emissions Directive (installations labelled with the letter E in column d of Annex 1 of the 4th BImSchV),
  • which is subject to authorisation in accordance with Section 60 (3) sentence 1 numbers 2 and 3 of the Water Resources Act (WHG) or
  • which constitutes an operating area pursuant to Section 3 (5a) of the Federal Immission Control Act (BImSchG) (hazardous incident operation).

For all other business premises, the responsibility lies

  • the municipal administration if the premises are located in an urban district.
  • the district authority if the premises are located in a district.

Please ensure that you submit the notification to the authority responsible for your premises.

Procedure

After you have notified a fumigation activity in advance, the competent authority will check your notification and request additional documents if necessary.

Deadlines

One week before the planned fumigation activity.

An exception applies to fumigation activities on ships and in containers in harbours, for which the application must be submitted 24 hours before the start of the activity.

Required documents

The following information is required for the notification:

  • Date of the activities
  • planned work steps
  • expected start and expected end of the activities
  • if necessary, dates of leak tests and release
  • Name and authorisation or registration number of the biocidal product or plant protection product and the quantity used
  • Name(s) of the person(s) responsible
  • Copies of the certificates of competence
  • Site plan of the location or the object to be fumigated
